Texas Enforcing Voter ID Law – Despite DOJ Attack

Early voting for the March Primary Election began today with Texas’ voter ID law enjoying full enforcement, despite U.S. Department of Justice objections in federal court. Just as Texans experienced in the 2013 Constitutional Election, voters must present an approved photo ID to cast a regular ballot at their polling place.

The Holder Justice Department filed a federal lawsuit against Texas in summer 2013 on the claim that voter ID was a violation of the Voting Right Act, as part of a wider national campaign to block election integrity reforms. On February 11, the DOJ requested the court consider postponing the September 2014 trial date – arguing they did not have ample time to analyze data among ethnic groups and, therefore, their effort would be “irreparably prejudiced” as a result. The DOJ was rejected on Friday.

Based on Heritage Foundation analysis of Texas’ initial voter ID election in 2013, the DOJ does not have the best minority voter turnout data to build a case upon. Senior Legal Fellow Hans von Spakovsky argues the “requirement has done nothing to suppress voter turnout throughout the state. In fact, turnout in last year’s constitutional elections in Texas yielded some of the highest turnout numbers in the past decade for similar type elections.” Spakovsky adds that compared to the last Constitutional Election in 2011, registered voter turnout had nearly doubled overall, across ethnic and economic segments as well.

At present, voter ID enforcement and the Holder Justice Department’s effort to dismantle the law are moving full speed ahead.

Texas Secretary of State Nandita Berry has continued public outreach efforts reminding voters to bring either a DPS-issued photo ID, U.S. Citizenship Certificate, Passport or military ID to the polls. Under the law, disabled persons may permanently exempt themselves. Should a voter need to cast a provisional ballot for lack of ID, they would have six days to return to their county voter registrar with acceptable identification to blend their ballot with the general count.

Should recent history repeat, the Davis Affidavit will likely continue to attract blaring headlines from some local papers in the 2014 voting periods. Often described as “snagging” or “causing hiccups,” Senator Wendy Davis’ amendment to the voter ID bill created a procedure for voters to affirm their identity, should their names not “significantly” match between voter registration records and their ID of choice. The Secretary of State continuously offers a free, online Voter Name and Address Changes system in order for Texans to spot and correct discrepancies in public records before voting. Voters signing affidavits will immediately be allowed to cast a regular ballot.

Given the current legal environment, a considerable number of eyes will be on south Texas as federal litigators hope to quantify their theory of disproportionate impact experienced by Latino voters with the ID law. Cameron County Election Administrator Chris Davis claimed great confidence in local preparation for enforcing the law amid expected greater turnout on Sunday. Given the geographic proximity to a foreign country with a similar voter ID requirement, early confidence may be justified.

Citizen groups have also declared their intent to assist the voting public throughout the 2014 Election. Houston-based True the Vote once again switched on its voter ID assistance effort, “NeedID?” – offering compliance tips and important, official contact information. In addition a Cameron County group, Citizens Against Voter Abuse, has operated a door-to-door campaign to educate citizens on their rights as voters and tips to spot illegal campaign activity.

Texas Secretary of State Berry’s office will continue to showcase its VoteTexas platform for all 2014 Election needs.

    Hmmmmmm… Imagine that. Minority voter turn-out nearly doubling under times of Republican controll. Not just minority voter turn-out, but nearly ALL voter turn-out across ALL social/economic sectors! So… what party is the champion of fair voting practices for everyone? Yeah… those facts right there says that Eric Holder HAS no arguments! He needs to go home and nurse that hurt butt of his.
    Here in South Carolina for the last 12 years that I have voted I have witnessed voter fraud in all 3 of the districts that I have belonged to. I have witnessed persons with multiple State(s) IDs, voter registration cards from multiple districts and states, persons trying to use non-photo IDs, Poll Blockers, and Candidate Stumpers illegally trying to influence and intimidate people in line to vote. And every time I raised the alarm or voiced my concerns over the (obvious) fouls they tried to intimidate or marginalize me. Ain’t happening… I don’t shut up for illegal tom-foolery! If I only get to vote once, everyone else in this land is only going to vote once. At least while I’m watching.

      California should fall suit…I had to show birthcertificate and drivers license when I turned 21 to vote in 1966…. 21 was the legal age to vote then…any 18 year old in this day and age should have to take a test to be able to vote…but ID should be a preq to vote…

    There are 100 questions on the U.S. Citizenship test. Here are 2 that the Socialists should read.
    1. Name one right only for U.S. Citizens.
    Ans. Vote in a Federal election and run for Federal office.
    2. What is one responsibiliy that is only for U.S. Citizens?
    Ans. Serve on a jury and vote in a Federal election.

    So Holder et al insist Voter I.D. is racist. However it is one way to determine if the person is a USC. Want to vote? Present a passport or present a valid Certificate of Birth to get your Voter ID. Doing so will not put a burden on anyone young or old. It’s just an excuse to keep the racist issue going. How do the unemployed and elderly get their benefits? They don’t just walk into the office and demand it. At some point they have to show ID.

      Yes, and all of our taxes are going to help pay for the minority, college, housing, early pre-k, etc. But the white people are still the devil for slavery that happened before they were alive. What about our ancestors that fought and died to free them you never hear about that. I have two white sons that have to grow up hearing how terrible white people are, they teach it in the schools, the president on the TV giving scholarships to the blacks kids. He could of turned this around for the better but he has made it a race war… It’s unbelievable to me because he has a white mother and was raised by his white grand parents.

    Every American citizen, in every state, eligible to vote deserve the RIGHT to have confidence in the electoral process particularly in this great country and that only citizens – eligible- vote a single vote and that can only be done with voter ID. My only concern is if NSA can go in and manipulate anything on any computer – and that the administration has been outsourcing ballot coounting to countries he offering (more) favors to. Personally, I’d feel more confidence if Voter ID and we had some tangible chads to count.

    I don’t see what the big deal is. We all as citizens are required by law to carry a state Id with us when in public so all they need to do is show what they should have with them any ways what will it hurt. Something tells me those who appose this are not being true to voters. I can think of only 1 excuse to appose the law and that is to get away with voting more than once at multiple polling place in a given election that’s the only reason to fight some thing s reasonable

    Only my last trip I had to show my ID at the airport twice to get on a plane and once at the bar while waiting. When I went to rent a car I needed to show my license then. I needed some allergy medicine when I got to the hotel and had to show my ID to buy that. Why isn’t it considered racist when I was asked all those times?

      You are required to show ID when you go to the doctors and use your ObamaCare and ObamaCare is now a mandate. It’s a Federal law ( Red Flags Rule ). The law states when using health insurance all doctors are required to take ID. If you pay cash, they are not required.

    I am in full support of showing your ID when going to vote. Its against the law to drive without it so really how hard is it to have it ready to show when you vote… 45 min wait you trying to tell me you can get it from your wallet to your hand? I do not want people voting who can not produce a state ID.

      Problem is a driver’s license is not proof you’re a U.S. citizen nor is any other state I.D. Everyone, at some point in their life, has had to produce a Certificate of Birth whether at the time they started school, applied for a SSN, joined the military, etc. Who doesn’t keep their birth cert in a safe place for when they might need it again? This is the Dirtbagocruds way of ensuring they get the votes no matter if legally or not and they prefer it be illegally.

        Some states require either a passport or Birth Certificate for drivers license now. My state required it when I got my last. In any case, it will still stop the people for voting for other people like the dead.

    You are required by Federal Law to give a doctor a photo ID. (Red Flag Law – google it if you dont believe me) ObamaCAre is now a mandate, everyone MUST buy health insurance. So, that means everyone has to have a photo ID to use ObamaCare. If they are forced by penalty tax to buy ObamaCare needing and ID, then why is it considered racist to show that same ID to vote?

    Good for Texas! I will be moving out of NY State to NC where Voter ID will be beginning in the 2016 elections. We have a lot of voter fraud going on in many of the states, particularly in the swing states. FWIW The Dems want to take over Texas bc it keeps growing and they want all those electoral votes for their candidates while they are losing them in many of the Dem strongholds such as NY where I am from. The bleeding hasn’t stopped in NY State and they will lose even more Congressional seats the next census so the Dems are looking for more to replace the ones they are losing
